The Court met pursuant to the adjourment of Yesterday
Present, The same Judges as of Yesterday --

} Petition for Partition
           Come the said petitioner by Bright & Pitcher his Counsel, and Samuel Goodnow, David Cummins and William J. Lodge the Commissioners appointed at a former day in the term to make partition of the Land named and Set forth in the petition of the said petitioner, and made the following report towit:
Hon. the judges of the Jefferson Circuit Court. The undersigned Samuel Goodnow   William J. Lodge and David Cummins, commissioners appointed at the March Term 1839, of said Court on the application of Milton Stapp to make partition and division of a part of the south east quarter of section thirty four in Township four north of Range ten East, towit. Beginning at a Corner in the sectional line dividing sections thirty four (34) and thirty five (35) forty poles north from the south East corner of said section thirty four, Thence North with said sectional line, to the north east corner of said south East quarter of section thirty four (34). Thence west with the open line of said section about 36 poles 9 links to a corner in Wilbers line of land, purchased by said Wilber of David Vawter. Thence with the east line of said tract, purchased by said Wilber of said Vawter , to the south East corner of said tract, Thence west with the south line of said tract about 65 perches to the east line of John McIntires fifty acre tract, taken off of said quarter, Thence south with said line about 60 perches 2 links to a corner on the south Bank of Crooked creek, being the North west corner of John McIntires twenty four acre tract out of said quarter, Thence an eastward direction up Crooked creek along said McIntires north line of said twenty four acre tract to a corner on the north bank of said Crooked creek, north of the west line of a ten acre tract out of south east corner of said quarter, Thence south four poles to the south west corner of said ten acre tract, Thence East with the north line of said tract, Thence East with the north line of said ten acre tract 40 poles to the place of beginning containing in all sixty acres more or less. -- Report that having previously taken on oath before John J. Cross Esq. a Justice of the peace in and for the county aforesaid, honestly and faithfully to execute the trust reposed in them as commissioners as aforesaid, they did proceed to view and survey said premises and make division of the same as directed by the Court, They find by actual survey that there are in said tracts of land, Fifty nine acres and ninety hundredths; and they divide the same into two equal parts (taking into view quantity and quality-) as follows - Viz. By running a straight line from the corner in Wilbers line of land purchased of David Vawter (being the 3d corner above named) south three degrees and twenty minutes west one hundred and sixteen poles and six links to the North East corner of McIntires twenty four acre tract above named (being the 7th corner above named) - and we do set over and alot to said Milton Stapp in severally all that part of said tract, lying east of the line last named, being twenty eight acres and twelve hundredths - We make a plot and survey of said ground a part hereof, all which is respectfully submitted --
Witness the hands and seals of said Commissioners this fourth day of April in the year of our Lord one thousand eight hundred and thirty nine. --

Jefferson County Sct. } Be it remembered that on this 4. Day of April 1839, before me one of the associate Judges of said county personally appeared before me (and in open court the above named Samuel Goodnow, William J. Lodge and David Cummins, commissioners for making partition &c. and acknowledged the foregoing report and act of partition to have been made by them as in said report set sorth --

Jefferson County Sct. } Samuel Goodnow, William J. Lodge and David Cummins being Duly sworn say that they will honestly and faithfully execute the trust reposed in them as commissioners for dividing deed making partition of the land for which they were appointed on the application of Milton Stapp, at the March Term 1839 of the Jefferson Circuit Court --

which report and plat being seen and inspected by the Court is in all things approved and confirmed accordingly - and accepted by the Court, and declared to be a partition of the premises therin mentioned. And it ordered by the Court that the commissioners in this case be allowed as follows towit
Samuel Goodnow Two Dollars - $2.00
David Cummins 2.00
William J. Lodge 2.00
Lyman Lathrop for carrying chain 1.50
Thomas Lockard 1.50
Saml. Goodnow for surveying 5.00

and the Court further order that the said petitioner pay the costs of this proceeding, all of which is finally ordered and Decreed --
